These Terms govern your access to and use of Pounce, including the Windows application, Pounce Cloud, documentation, support, alerts, and related services. By using Pounce, you agree to these Terms.
1. What Pounce Does
Pounce is a local Facebook Marketplace monitoring tool for deal discovery. It can scan Marketplace through accounts you configure, filter listings, estimate resale potential, send notifications, optionally send one opener to sellers, and show seller replies.
2. Your Responsibilities
- You are responsible for the Facebook accounts, proxies, notification channels, search rules, pricing settings, and message templates you configure.
- You are responsible for complying with applicable laws and third-party platform terms.
- You are responsible for verifying listings, seller identity, item condition, resale value, pickup safety, and transaction details before acting.
- You may not use Pounce for fraud, harassment, spam, illegal activity, or deceptive transactions.
3. Account and Platform Risk
Marketplace automation can carry account risk. Facebook, Meta, eBay, Discord, Telegram, Whop, or other third parties may restrict, block, rate-limit, challenge, or terminate accounts or access. Pounce is designed to operate conservatively, but no automation tool can guarantee zero account risk, uninterrupted access, or platform compatibility.
4. No Profit Guarantee
Pounce does not guarantee profit, alerts, speed, item availability, seller response, resale value, or successful deals. Pricing, AI verification, condition handling, ROI estimates, and seller checks are decision-support tools and may be wrong. You are responsible for final judgment.
5. Subscriptions, Access, and Updates
Access may require an active license, subscription, or membership through Whop or another billing provider. Pounce may check license status periodically. Product limits, features, prices, and availability can change over time. Updates may be required for continued use.
6. Refunds and Cancellations
Unless a written offer states otherwise, subscription renewals can be cancelled for future billing periods but are not automatically refundable for time already used. Initial access fees, beta access, and digital software access may be non-refundable once delivered. Any refund exception is handled at our discretion or through the billing platform.
7. Support and Diagnostics
Pounce may provide support through Discord, Whop, email, or in-app bug reports. Support bundles are diagnostic exports and are designed not to include Facebook cookies, saved browser sessions, browser profile folders, saved account credentials, webhook secrets, or proxy passwords.
8. Third-Party Services
Pounce depends on third-party services including Facebook Marketplace, eBay, OpenAI, Whop, Discord, Telegram, hosting providers, and proxy providers. Pounce is not affiliated with Facebook, Meta, eBay, Whop, Discord, Telegram, or OpenAI. Third-party outages or changes can affect Pounce.
9. Termination
We may suspend or terminate access for abuse, payment issues, security risk, violation of these Terms, or behavior that harms Pounce, other users, or third-party platforms.
10. Limitation of Liability
To the maximum extent permitted by law, Pounce is provided as-is and as-available. We are not liable for lost profits, missed deals, account restrictions, data loss, platform changes, third-party failures, or indirect damages arising from your use of Pounce.
11. Changes
We may update these Terms as the product changes. Continued use after changes means you accept the updated Terms.
